1. Agreement

By accessing or using SuperFly Mail (the “Service”), you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the Service.

2. The Service

SuperFly Mail lets you compose rich messages (optionally with attachments), protect them with a password, set expiry or delete-on-read behavior, and share them via short links so recipients can open them without an email account. Features may include comments, read receipts, AI assist tools, invitations, subscriptions, and SuperCopy peer-to-peer transfers. Features vary by plan and may change. Sending a message requires an account. Recipients do not need an account to open a shared link.

3. Eligibility and accounts

You must be legally able to enter a contract. You are responsible for your account credentials and for activity under your account. Provide accurate information. We may suspend or terminate accounts that violate these Terms or pose risk to the Service or other users.

4. Acceptable use

You agree not to: use the Service for unlawful, harmful, fraudulent, or abusive content; harass others; distribute malware; infringe IP or privacy rights; attempt unauthorized access; scrape or overload the Service; bypass tier limits, security, or access controls; or misuse short links (for example phishing). We may remove content or disable links that violate these rules.

5. Your content and licenses

You retain ownership of content you create. You grant Soft Romanesc a limited license to host, transmit, display, and process that content solely to operate the Service (including generating short links, storing attachments, delivering to recipients, and running features you enable such as AI). You represent you have the rights needed to submit the content and to share it via a link.

6. Shared links and recipients

Short links can be opened by anyone who has the URL (and password if set). You control sensitivity: choose passwords, expiry, and delete-on-read wisely. We are not responsible for recipients’ onward sharing or for access after you intentionally distribute a link.

7. Plans, trials, and payments

Free and paid tiers impose limits (messages, storage, AI usage, features). Trials and redeem codes may change access temporarily. Paid plans are billed through the applicable store or payment provider; their refund and billing rules apply. Fees are generally non-refundable except where required by law or the platform’s policies. We may change pricing or limits with notice where required.

8. AI features

AI tools are optional and may produce incorrect or incomplete results. You are solely responsible for reviewing AI output before sending. AI may be unavailable, rate-limited, or disabled for your plan or account.

9. SuperCopy

SuperCopy depends on device connectivity and peer availability. Transfers may fail due to network conditions. You are responsible for what you choose to transfer and for verifying you are connected to the intended session or device.

10. Availability and changes

We aim for reliable uptime but do not guarantee uninterrupted or error-free service. We may modify, suspend, or discontinue features. Message retention is subject to expiry settings, delete-on-read, deletion by you, and our retention practices.

11. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SOFT ROMANESC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) EUR 50.

13. Indemnity

You will defend and indemnify Soft Romanesc against claims arising from your content, your use of short links, your violation of these Terms, or your violation of others’ rights, to the extent permitted by law.

14. Termination

You may stop using the Service at any time. We may suspend or terminate access for violations, risk, non-payment, or extended inactivity. Provisions that by nature should survive (including ownership, disclaimers, liability limits) will survive termination.

15. Governing law

These Terms are governed by the laws of Romania, excluding conflict-of-law rules. Courts in Bucharest, Romania have exclusive jurisdiction, except where mandatory consumer protections say otherwise.

16. Changes to Terms

We may update these Terms. The “Last updated” date will change, and material updates may be announced in-app. Continued use after the effective date constitutes acceptance.
